I have not looked at what emerged from Select Committee. Where there is clearly new evidence, especially if the absence of it in the first trial is attributable to the accused, I did not think it objectionable to re-charge in principle. Repeated trials for hung juries, and other procedural defects are just as burdensome, and perhaps more unfair.
I am concerned generally about the kinds of evidence that can be manufactured to suit the purpose (like cell-mate confessions) so the safeguards against using the first trial as a test run will be important.
